The Secretary of State for Environment, Food and Rural Affairs and the National Assembly for Wales being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly (the National Assembly for Wales acting in relation to Wales only), in exercise of the powers conferred upon them by that section, make the following Regulations:
Citation, interpretation and commencement
1.
—(1) These Regulations may be cited as the Plant Protection Products (Amendment) Regulations 2006.
(2) In these Regulations "the Principal Regulations" means the Plant Protection Products Regulations 2005[3].
(3) Subject to paragraph (4) to (9), these Regulations shall come into force on 1st June 2006.
(4) Regulation 4 shall come into force on 1st September 2006.
(5) Regulation 5 shall come into force on 1st October 2006.
(6) Regulation 6 shall come into force on 1st November 2006.
(7) Regulation 7 shall come into force on 1st January 2007.
(8) Regulation 8 shall come into force on 1st February 2007.
(9) Regulation 9 shall come into force on 1st April 2007.
Amendment to the Principal Regulations
2.
The Principal Regulations are amended in accordance with regulations 3 to 9.
Amendment coming into force on 1st June 2006
3.
At the end of Schedule 1, insert in the respective columns indicated the entry set out in Part 1 of the Schedule to these Regulations.
Amendment coming into force on 1st September 2006
4.
At the end of Schedule 1, insert in the respective columns indicated the entries set out in Part 2 of the Schedule to these Regulations.
Amendment coming into force on 1st October 2006
5.
At the end of Schedule 1, insert in the respective columns indicated the entries set out in Part 3 of the Schedule to these Regulations.
Amendment coming into force on 1st November 2006
6.
At the end of Schedule 1, insert in the respective columns indicated the entry set out in Part 4 of the Schedule to these Regulations.
Amendment coming into force on 1st January 2007
7.
At the end of Schedule 1, insert in the respective columns indicated the entries set out in Part 5 of the Schedule to these Regulations.
Amendment coming into force on 1st February 2007
8.
At the end of Schedule 1, insert in the respective columns indicated the entry set out in Part 6 of the Schedule to these Regulations.
Amendment coming into force on 1st April 2007
9.
At the end of Schedule 1, insert in the respective columns indicated the entries set out in Part 7 of the Schedule to these Regulations.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Plant Protection Products Regulations 2005 (S.I. 2005/1435) ("the Principal Regulations") which implement in England and Wales Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ No. L230, 19.8.91, p.1, as read with corrigenda published in OJ No. L170, 25.6.92, p.40).
Schedule 1 to the Principal Regulations, which sets out the instruments that amend that Directive, is amended by the insertion of the entries set out in the various Parts of the Schedule to these Regulations, which list additional Directives that add one or more further active substances to Annex I of the Council Directive. In consequence the list of active substances which can be used in products capable of being approved under regulations 5 and 6 of the 2005 Regulations for placing on the market and use is extended accordingly.
The amendments relating to the entries set out in Parts 1 to 7 of the Schedule come into force as follows:
Part 1: 1st June 2006
Part 2: 1st September 2006
Part 3: 1st October 2006
Part 4: 1st November 2006
Part 5: 1st January 2007
Part 6: 1st February 2007
Part 7: 1st April 2007
A full regulatory impact assessment has not been prepared in respect of these Regulations as they have no impact on the costs of business.
