The Day Care and Child Minding (Registration Fees) (England) (Amendment) Regulations 2006

In exercise of the powers conferred on the Secretary of State by sections 79E(2)(c) and 104(4) of, and paragraph 7 of Schedule 9A to, the Children Act 1989[1], the Secretary of State for Education and Skills makes the following Regulations:

Citation, commencement, application and interpretation
     1. —(1) These Regulations may be cited as the Day Care and Child Minding (Registration Fees) (England) (Amendment) Regulations 2006 and come into force on 2nd October 2006.

    (2) These Regulations apply only in relation to England.

    (3) In these Regulations "the 2005 Regulations" means the Day Care and Child Minding (Registration Fees) (England) Regulations 2005[
2].

Amendment of the 2005 Regulations
     2. The 2005 Regulations are amended in accordance with regulations 3 and 4.

    
3. In regulation 3—

    (1) for "£14", in each place where it appears, substitute "£18";

    (2) for "£121" substitute "£150".

    
4. In regulation 4—

    (1) for "£11", in each place where it appears, substitute "£14";

    (2) for "£94" substitute "£120".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Day Care and Child Minding (Registration Fees) (England) Regulations 2005 (SI 2005/2301). Day care providers and child minders looking after children under the age of 8 are required to register under part 10A of the Children Act 1989. The Regulations increase the fee for an application for registration as a day care provider from £121 to £150 where the provider provides at least 4 hours care a day and from £14 to £18 where the provider provides less than 4 hours a day. The fee for an application for registration as a child minder is increased from £14 to £18. The annual fee payable by registered day care providers is increased from £94 to £120 (where at least 4 hours care a day is provided) and from £11 to £14 where less than 4 hours care is provided. The annual fee payable by registered child minders is increased from £11 to £14.
