The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as the A595 Grizebeck to Chapel Brow Trunk Road (Parton to Lillyhall Improvement) (Detrunking) Order 2006 and shall come into force on 18th August 2006.

In this Order—
(i) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(ii) "the new trunk road" means the new trunk road the Secretary of State proposes to construct referred to in article 2.2(i) of the A595 Grizebeck to Chapel Brow Trunk Road (Parton to Lillyhall Improvement) Order 2006.[3];
(iii) "the trunk road" means the Grizebeck to Chapel Brow Trunk Road (A595).

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies the Cumbria County Council that the new trunk road is open for traffic.

Length of the Trunk Road ceasing to be a Trunk Road
The length of the trunk road ceasing to be a trunk road is situated between a point 245m south of A595/U4009 junction at the A595/Furnace Row junction and is shown by broad black dashes on the plan numbered HA 10/MP/020, marked "The A595 Grizebeck to Chapel Brow Trunk Road (Parton to Lillyhall Improvement) (Detrunking) Order 2006" signed by authority of the Secretary of State for Transport, and deposited at DfT Records Management, Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
