The Secretary of State for Transport and the Scottish Ministers jointly make the following Order in exercise of the powers conferred by sections 43(3)(c) and 56(5) of the Railways Act 2005[1].
In accordance with section 42(7) of that Act, the Secretary of State and the Scottish Ministers have consulted with such persons operating railway passenger services, networks and stations that are affected by the proposed closures guidance and with such other persons as they think appropriate.
In accordance with section 43(1) of that Act, the Secretary of State has laid a copy of the closures guidance before each House of Parliament.
In accordance with section 43(2) of that Act, the Scottish Ministers have laid a copy of the closures guidance before the Scottish Parliament.
Citation commencement and interpretation
1.
—(1) This Order may be cited as the Closures Guidance (Railway Services in Scotland and England) Order 2006 and shall come into force on 1st December 2006.
(2) In this Order, "the Act" means the Railways Act 2005.
Closure guidance
2.
—(1) The closures guidance dated 18th October 2006 and laid before Parliament and the Scottish Parliament on 24th October 2006 is to have effect in relation to the proposals specified in paragraph (2).
(2) The proposals are as follows—
(a) the proposals referred to in section 42(1) of the Act; and
(b) the proposals referred to in section 42(2) of the Act, in so far as they relate to proposals to discontinue any cross-border services in relation to which—
(i) the Secretary of State provides funding; or
(ii) both the Scottish Ministers and the Secretary of State provide funding.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order gives effect to the closures guidance which is required to be published by the Secretary of State and Scottish Ministers. The closures guidance relates to the following proposals:
(a) proposals to discontinue any Scotland-only service or services;
(b) proposals to discontinue any cross border service;
(c) proposals to discontinue a network or part of a network that is wholly in Scotland; and
(d) proposals to discontinue the use or operation of any station or part of a station that is wholly in Scotland.
"Cross-border services" are defined in section 83 of the Railways Act 1993 and that definition has effect in the Railways Act 2005 as a result of section 58(2) of the Railways Act 2005.
