The Pensions Act 2004 (Codes of Practice) (Member-nominated Trustees and Directors and Internal Controls) Appointed Day Order 2006
The Secretary of State for Work and Pensions makes the following Order in exercise of the powers conferred by section 91(9) of the Pensions Act 2004[1].
Citation
1.
This Order may be cited as the Pensions Act 2004 (Codes of Practice) (Member-nominated Trustees and Directors and Internal Controls) Appointed Day Order 2006.
Appointed day
2.
The day appointed for the purposes of section 91(9) of the Pensions Act 2004 (procedure for issue and publication of codes of practice) for the coming into effect of—
(a) the Pensions Regulator Code of Practice No. 8: Member-nominated Trustees and Directors – putting in place and implementing arrangements; and
(b) the Pensions Regulator Code of Practice No. 9: Internal Controls,
is 22nd November 2006.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order appoints the day for the purposes of section 91(9) of the Pensions Act 2004 (c.35) (procedure for issue and publication of codes of practice) for the coming into effect of—
—
the Pensions Regulator Code of Practice No. 8: Member-nominated Trustees and Directors– putting in place and implementing arrangements; and
—
the Pensions Regulator Code of Practice No. 9: Internal Controls,
as 22nd November 2006.
An assessment of the impact on business, charities or the voluntary sector of the provisions relating to Member-nominated Trustees and Directors and the provisions relating to Internal Controls was included in the Regulatory Impact Assessment that accompanied the Pensions Act 2004 and the Occupational Pension Schemes (Internal Controls) Regulations 2005 (S.I. 2005/3379) respectively. A copy of the assessment has been placed in the libraries of both Houses of Parliament. Copies may be obtained from the Department for Work and Pensions, Better Regulation Unit, level 4, Adelphi, John Adam Street, London WC2N 6HT.
