The Childcare Act 2006 (Commencement No. 1) Order 2006
The Secretary of State for Education and Skills, in exercise of the powers conferred by section 109(2) of the Childcare Act 2006[1], makes the following Order:
Citation
1.
This Order may be cited as the Childcare Act 2006 (Commencement No.1) Order 2006.
Provisions of the Childcare Act 2006 coming into force on 20th December 2006
2.
The following provisions of the Childcare Act 2006 come into force on 20th December 2006—
(a) sections 1, 11, 12 and 13 for the purposes of making regulations;
(b) sections 18 (meaning of childcare), 19 (meaning of "young child"), 20 (meaning of "early years provision") and 21 (interpretation of Part 1);
(c) sections 39 (the Early Years Foundation Stage), 41 (the learning and development requirements), 42 (further provisions about assessment arrangements), 43 (welfare requirements), 44 (instruments specifying learning and development or welfare requirements), 45 (procedure for making certain orders) and 46 (power to enable exemptions to be conferred);
(d) sections 62, 63, 64, 67, 69, 74, 83, 84, 90, 92, 96 and 99 for the purposes of making regulations;
(e) sections 71 (termination of voluntary registration on expiry of prescribed period), 75 (disqualification from registration), 89 (fees), 98 (interpretation of Part 3) and 100 (provision of information about young children: transitory provision);
(f) section 102 (disqualification for registration under Children Act 1989) in relation to England.

EXPLANATORY NOTE
(This note is not part of the Order)
This is the first Commencement Order made under the Childcare Act 2006.
Article 2 sets out provisions of the Childcare Act 2006 coming into force on 20th December 2006 to the extent specified in each paragraph. Article 2(a) lists provisions in Part 1 (general functions of local authority: England) coming into force for the purposes of making regulations only. Article 2(b) lists interpretation provisions in Part 1 coming into force in full. Article 2(c) lists provisions relating to the Early Years Foundation Stage coming into force in full. Article 2(d) lists provisions in Part 3 (regulation of provision of childcare in England) coming into force for the purposes of making regulations only. Article 2(e) lists provisions coming into force in full. Article 2(f) brings section 102 of the Childcare Act 2006 into force in relation to England.
