IMMIGRATION

The Immigration, Asylum and Nationality Act 2006 (Commencement No. 5) Order 2007

  Made 19th February 2007 

The Secretary of State, in exercise of the powers conferred by section 62 of the Immigration, Asylum and Nationality Act 2006[1], makes the following Order:

Citation
     1. This Order may be cited as the Immigration, Asylum and Nationality Act 2006 (Commencement No. 5) Order 2007.

Commencement
    
2. Paragraph 6 of Schedule 2 to the Immigration, Asylum and Nationality Act 2006, and section 52(7) of that Act in so far as it relates to that paragraph, shall come into force on 7th March 2007.

EXPLANATORY NOTE

(This note is not part of the Order)


Article 2 brings into force paragraph 6 of Schedule 2 to the Immigration, Asylum and Nationality Act 2006 ("the 2006 Act"), and section 52(7) of that Act in so far as it relates to that paragraph. Those provisions amend section 42 of the Asylum and Immigration (Treatment of Claimants, etc) Act 2004.

Section 42 of that Act allows the Secretary of State when prescribing a fee for certain applications or processes under section 51 of the 2006 Act to prescribe an amount which is intended to exceed the administrative costs in respect of that application or process and reflect benefits that the Secretary of State thinks are likely to accrue to the person who makes the application, or for whom the process is undertaken, if the application is successful or the process is completed.
