The Diseases of Fish (England and Wales) Order 2007

  Made 15th March 2007 
  Laid before Parliament 16th March 2007 
  Coming into force 6th April 2007 

The Secretary of State, in exercise of the powers conferred on him by section 13(1) of the Diseases of Fish Act 1937[1], makes the following Order.

Title, extent and commencement
     1. This Order may be cited as the Diseases of Fish (England and Wales) Order 2007; it extends to England and Wales and comes into force on 6th April 2007.

Amendment of definition of "infected" in Diseases of Fish Act 1937
    
2. In the definition of "infected" in section 10(1) of the Diseases of Fish Act 1937[2], after "infectious salmon anaemia (ISA)," insert "Koi Herpesvirus Disease,".

EXPLANATORY NOTE

(This note is not part of the Order)


Article 2 of this Order amends the list of diseases in section 10(1) of the Diseases of Fish Act 1937 by adding Koi Herpesvirus Disease.

A full regulatory impact assessment of the effect that this instrument will have on the costs of business and the voluntary sector has been placed in the library of both Houses of Parliament, and copies may be obtained from the Aquatic Animal Health Team, Department for Environment, Food and Rural Affairs, Area 108, 1A page Street, London SW1P 4PQ.


Notes:

[1] 1937 c. 33; the definition of "the Minister" in section 10(1) was inserted by section 5 of, and the Schedule, paragraph 8 to, the Diseases of Fish Act 1983 (c. 30). A new section 13 was substituted by section 4(6) of the Diseases of Fish Act 1983. Powers of the Minister of Agriculture, Fisheries and Food were transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002, S. I. 2002/794. By virtue of article 2(a) of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the functions exercisable under section 13 of the 1937 Act were transferred to the National Assembly for Wales, concurrently with any Minister of the Crown by whom they are exercisable, in so far as exercisable in relation to Wales.back
