The Diseases of Animals (Approved Disinfectants) (Fees) (England) Order 2007

  Coming into force 3rd September 2007 

The Secretary of State, in exercise of his powers under section 84(1) of the Animal Health Act 1981[1], and with the approval of the Treasury, makes the following Order.

Title, application and commencement
     1. This Order—

Fees for applications for the approval of disinfectants
    
2. A person who applies for a disinfectant to be approved under article 3 of the Diseases of Animals (Approved Disinfectants) (England) Order 2007[2] must, when applying, pay to the Secretary of State the fees set out in the second column of the Schedule.

Revocation
     3. The Diseases of Animals (Fees for the Testing of Disinfectants) (England) Order 2005[3] is revoked.

3. Fee for testing for approval for use in all other instances where there is a legislative requirement to use an approved disinfectant 645



EXPLANATORY NOTE

(This note is not part of the Order)


This Order revokes and replaces the Diseases of Animals (Fees for the Testing of Disinfectants) (England) Order 2005 (S.I. 2005/379) ("the 2005 Fees Order").

The Order retains the previous fee for the administrative cost of dealing with the application for approvals, and for the cost of testing for approval for use in relation to foot-and-mouth disease and swine vesicular disease where there is a legislative requirement to use an approved disinfectant.

The old fee for testing for approval for use in relation to diseases of poultry if one dilution rate is specified by the person applying for approval of the disinfectant was £659 and is now £923. The old fee for testing for approval for use in relation to diseases of poultry if three dilution rates are specified by the person applying for approval of the disinfectant was £874.20 and is now £1,257. The old fee for testing for approval for use in relation to tuberculosis was £1,110 and is now £1,183. The old fee for testing for approval for use in all other instances where there is a requirement to use an approved disinfectant was £606 and is now £645.

A full impact assessment has not been produced for this instrument as a minimal impact on the private or voluntary sectors is foreseen.
