The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in her[2]—
1.
This Order may be cited as the A449 Trunk Road (Dudley, Staffordshire and Worcestershire) (Detrunking) Order 2007 and shall come into force on 1st October 2007.
2.
In this Order—
(i) all measurements of distance are measured along the route of the relevant highway;
(ii) "the plan" means the folio numbered HA 10/TD/019 consisting of a key plan and seven site plans numbered sheets 1 to 7 and marked "The A449 Trunk Road (Dudley, Staffordshire and Worcestershire) (Detrunking) Order 2007" signed by the authority of the Secretary of State for Transport and deposited at the ODPM—DfT Records Management Branch, Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;
(iii) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads; and
(iv) "the trunk road" means the Worcester to Wolverhampton Trunk Road (A449).
3.
The length of the trunk road described in the Schedule shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

SCHEDULE
LENGTHS OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The length of the trunk road ceasing to be a trunk road is situated:
(i) between the Boundary of Wolverhampton 250 metres northeast of Showell Lane Roundabout (marked "A" on the plan) and the Boundary of Dudley 230 metres north of Holbeache Lane (marked "B" on the plan), a distance of approximately 4.9 kilometres, all in the County of Staffordshire;
(ii) between the Boundary of Staffordshire 230 metres north of Holbeache Lane (marked "B" on the plan) and the junction with the A4101 (marked "C" on the plan), a distance of approximately 2.5 kilometres, all in the Metropolitan Borough of Dudley;
(iii) between the Boundary of Dudley (marked "C" on the plan) and the Boundary of Worcestershire 750 metres north of Caunsall Road (marked "D" on the plan), a distance of approximately 7.3 kilometres, all in the County of Staffordshire;
(iv) between the Boundary of Staffordshire (marked "D" on the plan) and the roundabout junction with the M5 Motorway, excluding the circulatory carriageway of that roundabout (marked "E" on the plan), a distance of approximately 29.4 kilometres, all in the County of Worcestershire.
The four lengths are shown by broad black dashes on the plan numbered HA 10/TD/019, marked "The A449 Trunk Road (Dudley, Staffordshire and Worcestershire) (Detrunking) Order 2007" signed by authority of the Secretary of State for Transport, ODPM-DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
