The Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) (No. 6) Order 2007

The Secretary of State, in exercise of the powers conferred by section 144(3)(b) and (14) of the Transport Act 2000[1], makes the following Order:

Citation and commencement
     1. This Order may be cited as the Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) (No. 6) Order 2007 and shall come into force on 2nd October 2007.

Specification of approved local authorities
    
2. The following authorities are specified as approved local authorities for the purposes of section 144 of the Transport Act 2000 (civil penalties for bus lane contraventions):

Amendment to the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005
     3. —(1) The Schedule to the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005[4] shall be amended as set out in paragraphs (2) and (3).

    (2) After the row in the table relating to Slough Borough Council, insert the following row—

"Solihull Metropolitan Borough Council S.I. 2007/2535"


    (3) After the row in the table relating to Southend-on-Sea Borough Council, insert the following row—

"Staffordshire County Council S.I. 2007/2534"

EXPLANATORY NOTE

(This note is not part of the Order)


The Bus Lane Contraventions (Penalty Charges, Adjudication and Enforcement) (England) Regulations 2005 (S.I. 2005/2757), made under section 144 of the Transport Act 2000, provide for the enforcement of bus lane restrictions through the imposition, by approved local authorities, of penalty charges in respect of contraventions of such restrictions. This Order specifies Solihull Metropolitan Borough Council and Staffordshire County Council as approved local authorities for these purposes.

The Order also makes a consequential amendment to the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005 (S.I. 2005/2755) to add Solihull Metropolitan Borough Council and Staffordshire County Council to the list of approved local authorities set out in the Schedule to that Order.

No impact assessment has been undertaken, since the Order is concerned with the enforcement of existing traffic restrictions and prohibitions and does not therefore constitute an additional burden on business. The costs incurred by local authorities undertaking enforcement are expected to be paid from the penalty charge income.
