The Safeguarding Vulnerable Groups Act 2006 (Commencement No. 1) (Northern Ireland) Order 2008

The Secretary of State makes the following Order in exercise of the powers conferred by sections 61(5) and 65 of the Safeguarding Vulnerable Groups Act 2006(1):

Citation and interpretation

1.–(1) This Order may be cited as the Safeguarding Vulnerable Groups Act 2006 (Commencement No. 1) (Northern Ireland) Order 2008.

(2) In this Order, "the Act" means the Safeguarding Vulnerable Groups Act 2006.

Provisions coming into force on 31st March 2008

2. 31st March 2008 is the day appointed for the coming into force in relation to Northern Ireland of the following provisions of the Act–

(a) section 1 and Schedule 1 (Independent Barring Board);

(b) sections 59 (vulnerable adults), 60 (interpretation) and 61 (orders and regulations) in so far as they relate to the provisions set out in paragraph (a).

EXPLANATORY NOTE

(This note is not part of the Order)

This is the second Commencement Order made under the Safeguarding Vulnerable Groups Act 2006 ("the Act"), but the first which commences provisions in so far as they extend to Northern Ireland.

Article 2 of this Order commences section 1 of, and Schedule 1 to, the Act in relation to Northern Ireland. These provisions provide for the establishment of the Independent Barring Board which will establish and maintain the children´s barred list and the adults´ barred list provided for under the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 (S.I. 2007/1351) (N.I. 11). It also commences the interpretive and ancillary provisions in sections 59 to 61 of the Act, in so far as they relate to section 1 and Schedule 1.
