The Public Service Vehicles (Operators´ Licences) (Fees) (Amendment) Regulations 2008

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 52(1)(a) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981(1) ("the 1981 Act") and by virtue of the Department of Transport (Fees) Order 1988(2).

Representative organisations have been consulted with in accordance with section 61(2) of the 1981 Act (3).

Citation and commencement

1. These Regulations may be cited as the Public Service Vehicles (Operators´ Licences) (Fees) (Amendment) Regulations 2008 and shall come into force on 1st August 2008.

Amendments

2. The Schedule to the Public Service Vehicles (Operators´ Licences) (Fees) Regulations 1995(4) (the "principal Regulations") is amended by substituting–

(a) in relation to fee number (i), "£224" for "£213";

(b) in relation to fee number (ii), "£148" for "£141";

(c) in relation to fee numbers (iii) and (iv), respectively–

(i) in column 3, "£148" for "£141"; and

(ii) in column 5, "£29" for "£28" in each place where it occurs;

(d) in relation to fee number (v), "£113" for "£108";

(e) in relation to fee numbers (vii) and (viii), respectively "£58" for "£56".

Transitional provisions

3. Where a decision has been made before the coming into force of these Regulations on an application for the grant of a standard or restricted licence under section 14(1) of the 1981 Act (5), the fee prescribed in the principal Regulations immediately before the coming into force of these Regulations applies.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations increase the fees which are payable under the Public Service Vehicles (Operators´ Licences) (Fees) Regulations 1995.

The fee increases, together with percentage increases, are shown in the table below. The fees were last increased on 1 April 2007.

The fees payable for issue of a disc under section 18 of the 1981 Act remain unchanged. Such fees are charged for each month or part of a month during which the disc is expressed to be in force and stand at £6, or £7 if an election has been made under regulation 11(4) of the Public Service Vehicles Operators´ Licences Regulations 1995 to pay annually. The fee payable for issue of a new disc in place of one lost or destroyed also remains unchanged at £15.

The Regulations also contain transitional provisions in respect of fees for the grant of a standard or a restricted operators´ licence.

Relevant amendments to sections 52(1) (a) and 60(1) of the 1981 Act were made by the Transport Act 1985 (c.67) (in these footnotes called "the 1985 Act") and by the Deregulation and Contracting Out Act 1994 (c.40) (in these footnotes called the 1994 Act"), as follows.
