The Secretary of State for Children, Schools and Families, makes the following Regulations in exercise of the powers conferred by sections 11A, 14(4)(b) and 16(3)(b) of the Education Act 2005(1):
1.–(1) These Regulations may be cited as the Education (School Inspection etc.) (England) (Amendment) Regulations 2008 and come into force on 1st September 2008.
(2) These Regulations apply in relation to schools in England.
2. In the Education (School Inspection) (England) Regulations 2005(2), for Regulation 8, substitute–
"8. For the purposes of sections 14(4)(b) and 16(3)(b) of the 2005 Act, the following are prescribed as cases where a fee may be charged for the provision of a copy of the report of a section 5 inspection of a school–
(a) where a registered parent of a registered pupil at the school, who has received a copy of the report pursuant to section 14(4)(c) or 16 (3)(c) of the 2005 Act, asks for a further copy of the report;
(b) where a copy of the report is asked for by any person other than a registered parent of a registered pupil at the school."
3. Regulation 3 of the Education (Investigation of Parents´ Complaints) (England) Regulations 2007(3) is amended as follows–
(a) at the end of paragraph (e), omit "and".
(b) at the end of paragraph (f) for the full stop, substitute "; and".
(c) after paragraph (f) insert–
"(g) the contribution made by the school to community cohesion.".

These Regulations amend two sets of regulations relating to school inspections.
Regulation 2 amends the Education (School Inspection) (England) Regulations 2005 so as to prescribe the cases where a school may charge for a copy of an inspection report. These are: (a) where a registered parent requests a further copy in addition to the copy of the report they are entitled to receive under section 14 or 16 of the Education Act 2005 (c.18), and (b) where anybody else requests a copy of the report from the school.
Regulation 3 amends the Education (Investigation of Parents´ Complaints) (England) Regulations 2007 so as to provide for a complaint about the contribution made by the school to community cohesion to be a qualifying complaint for the purposes of section 11A(2) of the Education Act 2005. This reflects the duty imposed on the Chief Inspector to report on the contribution, imposed by section 5(5)(g) of the Education Act 2005.
