The Road Safety Act 2006 (Commencement No. 3) Order 2008

The Secretary of State for Transport makes the following Order in exercise of the powers conferred by section 61 of the Road Safety Act 2006(1).

Citation

1. This Order may be cited as the Road Safety Act 2006 (Commencement No.3) Order 2008.

Commencement of section 46

2. Section 46 of the Road Safety Act 2006 (which extends Part 2 of the Vehicles (Crime) Act 2001(2) to Scotland and Northern Ireland) shall come into force on 31st July 2008.

Transitional provision

3. Sections 17(1) and 28 of the Vehicles (Crime) Act 2001 shall not apply before 1st November 2008 to any person in Scotland or Northern Ireland.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 31st July 2008 section 46 of the Road Safety Act 2006 (article 2).

Section 46 extends Part 2 of the Vehicles (Crime) Act 2001 to Scotland and Northern Ireland. Part 2 of the 2001 Act contains provisions regulating registration plate suppliers

The offences in section 17(1) (carrying on business as a registration plate supplier whilst unregistered) and 28 (selling a plate or other device as a registration plate and supplying a plate or device for unlawful activities) of the Vehicles (Crime) Act 2001 do not apply to persons in Scotland or Northern Ireland until 1st November 2008 (article 3).
