The Secretary of State makes the following regulations in exercise of the powers conferred by section 52 of the Trade Marks Act 1994(1).

Citation and commencement

1. These Regulations may be cited as the Community Trade Mark (Amendment) Regulations 2008 and shall come into force on 1st October 2008.

Amendment of the Community Trade Mark Regulations

2. In regulation 4(2) of the Community Trade Mark Regulations 2006(2) for the words "rules 31 to 37, 54 to 62, 67 to 69 and 72 of the Trade Marks Rules 2000" there shall be substituted "rules 38 to 43, 45, 62 to 79 and 82 of the Trade Marks Rules 2008".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These regulations make consequential amendments to the Community Trade Mark Regulations 2006 (S.I. 2006/1027) which arise from the revocation of the Trade Marks Rules 2000 (S.I. 2000/136) and their replacement by the Trade Marks Rules 2008 (S.I. 2008/1797) ("the 2008 Rules"). They also apply to Community Trade Marks provisions of the 2008 Rules relating to appeals from decisions of the registrar.

A separate impact assessment has not been produced for this instrument as it is made in consequence of the revocation and replacement of the Trade Marks Rules 2000 by the Trade Marks Rules 2008. However, a full impact assessment of the effect that the Trade Marks Rules 2008 will have on the costs of business and the voluntary sector is available from the UK Intellectual Property Office, Trade Marks Law Section, Concept House, Cardiff Road, Newport NP10 8QQ and is annexed to the Explanatory Memorandum which is available alongside that instrument on the OPSI website. Copies have also been placed in the libraries of both Houses of Parliament.
