The Secretary of State is satisfied that the National Consumer Council represents the interests of consumers and satisfies the other criteria published by the Secretary of State pursuant to section 11(6) of the Enterprise Act 2002(1). In exercise of the powers conferred by section 11 of the Enterprise Act 2002, the Secretary of State makes the following Order:
1. This Order may be cited as the Enterprise Act 2002 (Bodies Designated to make Super-complaints) (Amendment) Order 2008 and shall come into force on 1st October 2008.
2. For the list in the Schedule to the Enterprise Act 2002 (Bodies Designated to make Super-complaints) Order 2004(2) there is substituted–
"The Campaign for Real Ale Limited.
The Consumer Council for Water.
The Consumers´ Association.
The General Consumer Council for Northern Ireland.
The National Association of Citizens Advice Bureaux.
The National Consumer Council.".

The Secretary of State may designate any body that appears to him to represent the interests of consumers and satisfies the other criteria published by him as a designated consumer body for the purpose of submitting a "super-complaint" under section 11 of the Enterprise Act 2002.
This Order amends the Enterprise Act 2002 (Bodies Designated to make Super-complaints) Order 2004 (S.I. 2004/1517) to reflect the changes made by the Consumers, Estate Agents and Redress Act 2007 (the "2007 Act", c.17). Section 1 of the 2007 Act established a body corporate known as the National Consumer Council or in Welsh Cyngor Defnyddwyr Cenedlaethol (the "NCC"). The NCC will carry out the functions previously carried on by a body which was also known as the National Consumer Council, which is a company limited by guarantee and will be wound up. Section 30 of the 2007 Act provides for the abolition of both the Gas and Electricity Consumer Council and the Consumer Council for Postal Services and for the transfer of their functions to the NCC. Those bodies have, therefore, been removed from the list set out in the Schedule to the Order.
An impact assessment has not been prepared for this Order as no impact on the private or voluntary sectors is foreseen.
