The Secretary of State for Innovation, Universities and Skills makes the following Regulations in exercise of the powers conferred by sections 22, 42(6) and 43(1) of the Teaching and Higher Education Act 1998(1):

Citation, commencement and interpretation

1. These Regulations may be cited as the Education (Student Support) (European Institutions) (Amendment) (No. 2) Regulations 2008.

2.–(1) Except for regulation 8 these Regulations come into force on 1st January 2009.

(2) Regulation 8 comes into force on 1st September 2009.

3. In these Regulations, "the Principal Regulations" means the Education (Student Support) (European Institutions) (No. 2) Regulations 2006(2).

Amendment of the Principal Regulations

4. The Principal Regulations are amended in accordance with these Regulations.

5. In Regulation 3 in the definition of "relevant date" for "2008" substitute "2009".

6. In Regulation 8(3) for each occurrence of "2008" substitute "2009".

7. In Regulation 9(17)–

(a) for each occurrence of "2008" substitute "2009"; and

(b) for "2009" substitute "2010".

8. The Schedule to these Regulations has effect to substitute the figures in the third column of the table for the figures in the second column where they appear in the provisions of the Principal Regulations set out in the first column.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Student Support) (European Institutions) (No. 2) Regulations 2006 ("the Principal Regulations"). The Principal Regulations provide for support for eligible students taking designated higher education courses at Bologna Centre, the College of Europe or the European University Institute in respect of an academic year beginning on or after 1st September 2007. These Regulations and the Principal Regulations apply to England only.

Regulation 5 amends the definition of a "relevant date" from "1st February 2007" to "1st February 2008". Regulations 6 and 7 amend the deadlines for applications for support and the receipt of financial information for the academic year beginning on or after 1st September 2009.

The Schedule to these Regulations sets out the increase in the amounts of support payable to eligible students for the academic years beginning on or after 1st September 2009.

An impact assessment has not been produced for this instrument as it has no impact on business, charities or voluntary bodies. The impact on the public sector is minimal.
