At the Court at Buckingham Palace, the 10th day of December 2008

The Queen´s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by sections 5 and 7 of the West Indies Act 1962(1) and of all other powers enabling Her to do so, is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows:

(3) In this Order "the Constitution" means the Constitution set out in Schedule 2 to the principal Order.

(4) This Order shall come into force on such day as the Governor, acting in his discretion, may appoint by proclamation published in a Government Notice.

Amendment of Section 25 of the Constitution

2. Section 25 of the Constitution is amended–

(a) by substituting for the full stop at the end of paragraph (b)(vi) a semi-colon followed by the word "or"; and

(b) by inserting after paragraph (b) the following new paragraph–

"(c) on the day of the issue of a writ ordering an election, he is otherwise qualified under paragraph (b) but has not attained the age of eighteen years, but he will attain that age on or before the polling day at the election.".

Judith Simpson

Clerk of the Privy Council

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Constitution of the Cayman Islands so as to permit a person to be registered as an elector if he will have attained the age of eighteen years on or before the polling day at an election. This will entitle a person to vote who at the date of registration has not yet attained the age of eighteen years.

This changes the previous situation where, to be entitled to vote, a person had to have attained the age of eighteen years at the date of registration.
