The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Order 2009

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980(1) and now vested in him(2):

1. This Order may be cited as the A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads ) Order 2009 and shall come into force on 30th January 2009.

2. In this Order–

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) "the main new road" means the new highway which the Secretary of State proposes to construct along the route described in Schedule 1 to this Order;

(ii) "the new trunk roads" means the main new road and the slip roads;

(iii) "the plan" means the plan numbered HA 10/MP/090 shown on 3 sheets and marked "The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Order 2009", signed by authority of the Secretary of State for Transport and deposited at Department of Communities and Local Government–DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA; and

(iv) "the slip roads" means the new highways which the Secretary of State proposes to construct along the routes described in Schedule 2 to this Order and which connect the main new road with other highways or proposed highways at the places stated in that Schedule.

3. The main new road and the slip roads shall become trunk roads from the date when this Order comes into force.

4. The centre line of each of the trunk roads is indicated by a heavy black line on the plan.

5. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that–

(a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for traffic.

SCHEDULE 1 ROUTE OF THE NEW MAIN ROAD

The route of the main new road is about-

(1) 0.83 kilometres in length, from the point on the plan marked A on the A46 Trunk Road, about 640m north of Widmerpool junction at Widmerpool in the County of Nottinghamshire, northerly to the point on the plan marked B, about 290m south of Roehoe Junction;

(2) 1.47 kilometres in length, from the point on the plan marked C on the A46 Trunk Road, about 250m north of Owthorpe Road junction at Cotgrave in the County of Nottinghamshire, north-easterly to the point on the plan marked D about 340m north east of Colston Gate Junction;

(3) 0.13 kilometres in length, from the point on the plan marked E on the A46 Trunk Road, about 110m south west of Nottingham Road Junction at Stragglethorpe, in the County of Nottinghamshire, north-easterly to the point on the plan marked F about 20m north east of Nottingham Road Junction;

(4) 1.28 kilometres in length, from the point on the plan marked G on the A46 Trunk Road, about 190 m north east of Nottingham Road Junction at Grantham canal, in the County of Nottinghamshire, north-easterly to the point on the plan marked H, about 120m south west of Cropwell Road Junction;

(5) 6.52 kilometres in length, from the point on the plan marked J on the A46 Trunk Road, about 340m north of Cropwell Road at Cropwell Butler, in the County of Nottinghamshire, northerly / north-easterly to the point on the plan marked K about 300m north east of Closes Side Lane Junction;

(6) 0.16 kilometres in length, from the point on the plan marked L on the A46 Trunk Road, about 30m south west of Lodge Lane junction at Red Lodge, in the County of Nottinghamshire, north-easterly to the point on the plan marked M about 130m north east of Lodge Lane Junction; and

(7) 6.63 kilometres in length, from the point on the plan marked N on the A46 Trunk Road, about 60m south west of the junction with Longhedge Lane at Syerston in the County of Nottinghamshire, north-easterly to the point on the plan marked P the junction with Farndon Road.

SCHEDULE 2 ROUTES OF THE SLIP ROADS

The routes of the slip roads are as follows:

Junction with A52 Grantham Road at Saxondale

(1) Four routes to connect the main new road with a roundabout which the Secretary of State proposes to construct as part of the A52 Grantham Road at Saxondale (the slip roads along these routes being respectively given the numbers 10, 11, 12, and 13 on the plan);

Junction with Nottingham Road at Stragglethorpe

(2) Two routes to connect the north bound carriageway of the main new road with Nottingham Road (as proposed to be improved by the Secretary of State) at Stragglethorpe (the slip road along these routes being respectively given the numbers 7 and 8 on the plan);

Junction with Nottingham Road at Stragglethorpe

(3) Two routes to connect the south bound carriageway of the main new road with Nottingham Road (as proposed to be improved by the Secretary of State) at Stragglethorpe (the slip road along these routes being respectively given the numbers 6 and 9 on the plan);

Junction with A6097 at Margidunum

(4) Two routes to connect the north bound carriageway of the main new road with Margidunum junction (as proposed to be improved by the Secretary of State) at East Bridgford (the slip road along these routes being respectively given the numbers 15 and 16 on the plan);

Existing Junction at Widmerpool

(5) A route to connect the existing north bound slip road at Widmerpool with the north bound carriageway of the main new road (the slip road along this route being given the number 1 on the plan);

Proposed Junction at Car Colston

(6) A route from the south bound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Car Colston (the slip road along this route being given the number 14 on the plan);

Proposed Junction at Roehoe

(7) A route from the new highway which the Secretary of State proposes to construct at Roehoe junction to the south bound carriageway of the main new road (the slip road along this route being given the number 2 on the plan);

Proposed Junction at Roehoe

(8) A route from the new highway which the Secretary of State proposes to construct at Roehoe junction to the north bound carriageway of the main new road (the slip road along this route being given the number 3 on the plan);

Proposed Junction at Owthorpe

(9) A route from the new highway which the Secretary of State proposes to construct at Owthorpe junction to the south bound carriageway of the main new road (the slip road along this route being given the number 4 on the plan);

(17) A route from the new highway which the Secretary of State proposes to construct at Lodge Lane junction to the north bound carriageway of the main new road (the slip road along this route being given the number 23 on the plan).

Explanatory Note

(This note is not part of the Order)

This Order authorises improvements to the existing A46 Trunk Road and the construction of new lengths of trunk road and slip roads, to provide a largely dual carriageway between Newark and Widmerpool, east of Nottingham.

The route of the main new road is about

(i) 0.83 kilometres in length, from the point on sheet 1 of the plan marked A on the A46 Trunk Road, about 640m north of Widmerpool junction at Widmerpool in the County of Nottinghamshire, northerly to the point on sheet 1 of the plan marked B, about 290m south of Roehoe Junction;

(ii) 1.47 kilometres in length, from the point on sheet 1 of the plan marked C on the A46 Trunk Road, about 250m north of Owthorpe Road junction at Cotgrave in the County of Nottinghamshire, north-easterly to the point on sheet 1 of the plan marked D about 340m north east of Colston Gate Junction;

(vi) 0.16 kilometres in length, from the point on sheet 3 of the plan marked L on the A46 Trunk Road, about 30m south west of Lodge Lane junction at Red Lodge, in the County of Nottinghamshire, north-easterly to the point on sheet 3 of the plan marked M about 130m north east of Lodge Lane Junction; and

(vii) 6.63 kilometres in length, from the point on sheet 3 of the plan marked N on the A46 Trunk Road, about 60m south west of the junction with Longhedge Lane at Syerston in the County of Nottinghamshire, north-easterly to the point on sheet 3 of the plan marked P the junction with Farndon Road

The routes of the slip roads are as follows:

Junction with A52 Grantham Road at Saxondale

(1) Four routes to connect the main new road with a roundabout which the Secretary of State proposes to construct as part of the A52 Grantham Road at Saxondale (the slip roads along these routes being respectively given the numbers 10, 11, 12, and 13 on sheet 2 of the plan);

Junction with Nottingham Road at Stragglethorpe

(2) Two routes to connect the north bound carriageway of the main new road with Nottingham Road (as proposed to be improved by the Secretary of State) at Stragglethorpe (the slip road along these routes being respectively given the numbers 7 and 8 on sheet 1 of the plan);

(3) Two routes to connect the south bound carriageway of the main new road with Nottingham Road (as proposed to be improved by the Secretary of State) at Stragglethorpe (the slip road along these routes being respectively given the numbers 6 and 9 on sheet 1 of the plan);

Junction with A6097 at Margidunum

(4) Two routes to connect the north bound carriageway of the main new road with Margidunum junction (as proposed to be improved by the Secretary of State) at East Bridgford (the slip road along these routes being respectively given the numbers 15 and 16 on sheet 2 of the plan);

Existing Junction at Widmerpool

(5) A route to connect the existing north bound slip road at Widmerpool with the north bound carriageway of the main new road (the slip road along this route being given the number 1 on sheet 1 of the plan);

Proposed Junction at Car Colston

(6) A route from the south bound carriageway of the main new road to a new roundabout which the Secretary of State proposes to construct at Car Colston (the slip road along this route being given the number 14 on sheet 2 of the plan);

Proposed Junction at Roehoe

(7) A route from the new highway which the Secretary of State proposes to construct at Roehoe junction to the south bound carriageway of the main new road (the slip road along this route being given the number 2 on sheet 1 of the plan);

Proposed Junction at Roehoe

(8) A route from the new highway which the Secretary of State proposes to construct at Roehoe junction to the north bound carriageway of the main new road (the slip road along this route being given the number 3 on sheet 1 of the plan);

Proposed Junction at Owthorpe
