This Order is made in exercise of the powers conferred by section 89(3) of the Traffic Management Act 2004(1) and by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to that Act.
Bedfordshire County Council has applied to the Secretary of State for an order to be made under these powers in respect of part of its area(2).
The Secretary of State has consulted the Chief Constable of the Bedfordshire Police in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.
Accordingly, the Secretary of State for Transport(3) makes this Order.
1. This Order may be cited as the Civil Enforcement of Parking Contraventions (Bedford) Designation Order 2009 and shall come into force on 15th April 2009.
2. The Road Traffic (Permitted Parking Area and Special Parking Area) (County of Bedfordshire) (Borough of Bedford) Order 2000(4) is revoked.
3. The Secretary of State designates the area described in the Schedule as–
(a) a civil enforcement area for parking contraventions; and
(b) a special enforcement area.

Article 2
This Order applies to the area of the borough of Bedford ("the borough") with the exception of–
(a) the length of the A1 between Ordnance Survey National Grid reference points TL166582 and TL162546;
(b) the A6 from the north west roundabout at Clapham Road and Cut Throat Lane at Bedford to the junction with the Bedford Road at Oakley at the northern end of the Clapham bypass (between Ordnance Survey National Grid reference points TL037511 and TL019548);
(c) the A6 from the roundabout at the junction of the A5134 West End and the B530 at Elstow to the southern boundary of the borough (between Ordnance Survey National Grid reference points TL044473 and TL064422);
(d) the A6 from the roundabout at the junction of Mill Road at Sharnbrook to the northern boundary of the borough (between Ordnance Survey National Grid reference points TL014592 and TL985630);
(e) the length of the A421 (including the slip roads) between Ordnance Survey National Grid reference points TL160554 and TL008430;
(f) the A428 from the roundabout at the junction of Gold Lane at Biddenham to the junction with Station Road at Turvey (between Ordnance Survey National Grid reference points TL019505 and TL961522);
(g) the A428 from the junction with the A1 at St. Neots (at Ordnance Survey National Grid reference point TL0169579) to Ordnance Survey National Grid reference point TL189583;
(h) the A603 from the roundabout at the junction of the A421 Trunk Road at Cardington Cross to the junction with Willington Road at Cople (between Ordnance Survey National Grid reference points TL084485 and TL104493);
(i) the A600 from the southern boundary of Cotton End (at Ordnance Survey National Grid reference point TL085448) to Ordnance Survey National Grid reference point TL101428;
(j) the B530 from the roundabout at the junction of the A6 and the A5134 at Elstow to the junction with the A421 trunk road (between Ordnance Survey National Grid reference points TL044473 and TL037464); and
(k) the B530 from the interchange roundabout at the junction of Kempston Bypass and Ampthill Road at Kempston (at Ordnance Survey National Grid reference point TL041467) to Ordnance Survey National Grid reference point TL037438.

This Order designates the area described in the Schedule as a civil enforcement area for parking contraventions, and as a special enforcement area, for the purposes of Part 6 of the Traffic Management Act 2004. It revokes the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Bedfordshire) (Borough of Bedford) Order 2000 (S.I. 2000/2871).
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
Bedfordshire County Council ("the County Council") made its application in respect of the area of the Borough of Bedford (with the exception of the excluded areas described in the Schedule to this Order), being part of its area. On 1st April 2009 the county of Bedfordshire is abolished as a local government area and the County Council is wound up and dissolved (article 5 of the Bedfordshire (Structural Changes) Order 2008) (S.I. 2008/907) ("the 2008 Order"). On the same date, a new non-metropolitan county, known as Bedford, is constituted comprising the area of the borough of Bedford, and Bedford Borough Council becomes the sole principal authority for Bedford (article 3 of the 2008 Order). Single tier local government is also established on 1st April 2009 in respect of Central Bedfordshire (article 4 of the 2008 Order), but that change is not relevant to this Order. By virtue of the Local Government (Structural Changes) (Transitional Arrangements) (No 2) Regulations 2008 (S.I. 2008/2867), regulation 4(3) and (4)(e), the application made by the County Council has effect as if made by Bedford Borough Council. The area in respect of which the County Council made its application is the same geographical area that is designated by this Order. Back [2]
The Secretary of State is the "appropriate national authority" as regards England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act. Back [3]
