The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 17(2) and 17(3) of the Road Traffic Regulation Act 1984(1).
The Secretary of State has consulted with such representative organisations as were thought fit in accordance with section 134(2)(2) of that Act.
1. These Regulations may be cited as the M3 and M25 (Thorpe Interchange) (Speed Limit) Regulations 2009 and shall come into force on 10th July 2009.
2. In these Regulations–
"a link road" means–
the road leading from the clockwise carriageway at Junction 12 of the M25 Motorway at a point 1290 metres north of the Almners Road Overbridge to the westbound carriageway of the M3 Motorway at Junction 2; or
the road leading from the anti-clockwise carriageway at Junction 12 of the M25 Motorway at a point 1380 metres south of the Muckhatch Lane Overbridge to the westbound carriageway of the M3 Motorway at Junction 2;
"the M3 Motorway" means the M3 London to Southampton Motorway at Thorpe Interchange in the County of Surrey;
"the M25 Motorway" means the M25 London Orbital Motorway at Thorpe Interchange in the County of Surrey; and
"the westbound carriageway" means the westbound carriageway of the M3 Motorway between a point 840 metres east of Lyne Lane Overbridge and a point 1875 metres west of Lyne Lane Overbridge.
3. No person shall drive any motor vehicle at a speed exceeding 50 miles per hour on the westbound carriageway or any link road.

These Regulations impose a 50 miles per hour speed limit on the westbound carriageway of the M3 Motorway and the link roads leading from the clockwise and anticlockwise M25 Motorway to the westbound carriageway of the M3 Motorway, in the interests of road safety.
An impact assessment has not been produced for this instrument as it has no significant impact on business, charities or voluntary bodies and costs imposed on the public sector are less than £5 million.
A temporary order, made under sections 14(1)(a) and (b) of the Road Traffic Regulation Act 1984, imposing a 50 miles per hour speed limit has been in force since 27th January 2007 and expires on 26th July 2009. These Regulations will replace the temporary order.
