The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 35(2)(c), 36(2)(c), 89(1) and 104(2) of the Childcare Act 2006(1):
1. These Regulations may be cited as the Childcare (Fees) (Amendment) Regulations 2009 and come into force on 1st September 2009.
2.–(1) The Childcare (Fees) Regulations 2008(2) are amended as follows.
(2) In regulation 3, for "£25", substitute "£30".
(3) In regulation 4–
(a) in sub-paragraph (a), for "£25", substitute "£30";
(b) in sub-paragraph (b), for "£180", substitute "£200".
(4) In regulation 9(2), for "£25", substitute "£30".
(5) In regulation 10–
(a) in paragraph (2), for "£25", substitute "£30";
(b) in paragraph (3), for "£180", substitute "£200".

These Regulations amend the Childcare (Fees) Regulations 2008 (SI 2008/1804) to increase the fees payable by childcare providers who are registered in the early years register ("the EYR") under Part 3 of the Childcare Act 2006. The changes will take effect from 1st September 2009 and relate to the application fees for joining the EYR and the annual fees payable by childcare providers registered in the EYR. An Impact Assessment was produced for this instrument and is annexed to the Explanatory Memorandum which is available alongside the instrument on the OPSI website at http://www.opsi.gov.uk.
