The Secretary of State, in exercise of the powers conferred by section 1(5) of the Ministry of Defence Police Act 1987(1), makes the following Regulations:–
1.–(1) These Regulations may be cited as the Ministry of Defence Police (Committee) Regulations 2009 and shall come into force on 28th July 2009.
(2) The Ministry of Defence Police (Police Committee) Regulations 1995(2) are revoked.
2. There shall continue to be a Ministry of Defence Police Committee ("the Committee") appointed by the Secretary of State for Defence ("the Secretary of State") whose functions shall be–
(1) to advise the Secretary of State on matters concerning the Ministry of Defence Police; and
(2) to exercise any other functions conferred on it by regulations made under the Ministry of Defence Police Act 1987.
3. The members of the Committee shall be–
(a) an independent external member appointed by the Secretary of State, who shall be the chairperson of the Committee;
(b) a Police Adviser for England and Wales appointed by the Secretary of State;
(c) a Police Adviser for Scotland appointed by the Secretary of State;
(d) the Director General Human Resources and Corporate Services at the Ministry of Defence ;
(e) the Director of Business Resilience at the Ministry of Defence;
(f) three independent external members appointed by the Secretary of State;
(g) an official from Defence Security at the Ministry of Defence, who shall be the Clerk to the Committee.

These Regulations provide for the membership of the Ministry of Defence Police Committee. The Committee advises the Secretary of State on matters concerning the Ministry of Defence Police; and exercises other functions conferred on it by the Ministry of Defence Police Act 1987 and regulations made under it.
