Made
8th July 2009
Coming into force in accordance with Article 3
At the Court at Buckingham Palace, the 8th day of July 2009
Present,
The Queen´s Most Excellent Majesty in Council
In accordance with section 1(3) of the European Communities Act 1972(1), a draft of this Order was laid before and approved by a resolution of each House of Parliament.
Accordingly, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972, is pleased, by and with the advice of Her Privy Council, to order as follows:
1. This Order may be cited as the European Communities (Definition of Treaties) (Cariforum Economic Partnership Agreement) Order 2009.
2. For the purposes of this Order, references to the "Agreement" are to the Economic Partnership Agreement between the CARIFORUM States, of the one part, and the European Community and its Member States, of the other part (2).
3. This Order shall come into force on the date on which the Agreement enters into force for the United Kingdom. This date will be notified in the London, Edinburgh and Belfast Gazettes.
4. The Agreement is to be regarded as a Community Treaty as defined in section 1(2) of the European Communities Act 1972.
Judith Simpson
Clerk of the Privy Council
(This note is not part of the Order)
The European Community and its Member States have entered into an Economic Partnership Agreement (the "Agreement") with the CARIFORUM States (comprising Antigua and Barbuda, the Commonwealth of the Bahamas, Barbados, Belize, the Commonwealth of Dominica, the Dominican Republic, Grenada, the Republic of Guyana, the Republic of Haiti, Jamaica, Saint Christopher and Nevis, Saint Lucia, Saint Vincent and the Grenadines, the Republic of Suriname and the Republic of Trinidad and Tobago).
This Order declares the Agreement to be a Community Treaty as defined by section 1(2) of the European Communities Act 1972. The principal effect of declaring the Agreement to be a Community Treaty, as so defined, is that the provisions of section 2 of the European Communities Act 1972 (which provide for the implementation of Community Treaties) apply to it.
A full Impact Assessment has not been carried out for this Order as an initial assessment determined that the costs and benefits for business, the voluntary sector and public finances in the United Kingdom are expected to be negligible.
