The Secretary of State is designated for the purpose of section 2(2) of the European Communities Act 1972(1) in relation to measures relating to access to, the training for, the pursuit of and the award of qualifications in the profession of medicine and its specialties(2).
Accordingly, the Secretary of State in exercise of the power conferred by section 2(2) of that Act, makes the following Order.
1. This Order may be cited as the General and Specialist Medical Practice (Education, Training and Qualifications) Amendment Order 2009 and shall come into force on 28th August 2009.
2.–(1) Schedule 3 to the General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003(3) (specialties in which the UK awards a CCT and any minimum training periods) is amended as follows.
(2) In Part 1 (specialities with minimum training periods), for the entry relating to "Medical microbiology and virology" substitute–
""Medical microbiology (also known as microbiology and bacteriology)"
"Medical virology"".
(3) In Part 2 (other specialties)–
(a) insert in the appropriate alphabetical positions–
""Acute internal medicine"";
""Community sexual and reproductive health""; and
(b) omit the entry relating to "Clinical cytogenics and molecular genetics".
3. Article 2(2) does not prevent the award of a Certificate of Completion of Training in medical microbiology and virology to a person who, on the date when this Order comes into force, is undergoing the education and training necessary to obtain such an award.

This Order is made under section 2(2) of the European Communities Act 1972 (c.68). It gives effect to obligations in article 25 of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 (OJ No L 255, 30.09.2005, p.22 amended by Council Directive 2006/100/EC of 20 November 2006, OJ No L 363, 20.12.2006, p.141) which provides that specialist medical training must fulfil certain criteria therein specified.
Article 2 amends the list of specialties contained in Schedule 3 to General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003 (S.I.2003/1250) in which the United Kingdom awards Certificates of Completion of Training. The specialty of "medical microbiology and virology" is split into two separate specialties, new specialties of "acute internal medicine" and "community sexual and reproductive health" are recognised and the specialty of "clinical cytogenics and molecular genetics" is no longer recognised.
Article 3 makes a saving provision for those undergoing education and training, when the Order comes into force, necessary for the award of a Certificate of Completion of Training in medical microbiology and virology.
A full impact assessment has not been produced for this instrument as it has no impact on the private or voluntary sectors.
