The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 1, 3, 34, 35, 35A(2) and 47 of, and paragraphs 1, 2, 4, 4A, 7, 8 and 10 of Schedule 1 to, the Building Act 1984(1).
1.–(1) These Regulations may be cited as the Building and Approved Inspectors (Amendment No.2) Regulations 2009.
(2) These Regulations shall come into force on 30th September 2009.
2. The Building and Approved Inspectors (Amendment) Regulations 2009(2) are amended as follows–
(a) in regulation 1(2) (citation and commencement), for "1st October 2009" substitute "6th April 2010";
(b) in regulation 5(1), (2) and (3) (transitional provisions: work already commenced), for "1st October 2009" substitute "6th April 2010"
(c) in regulation 6 (transitional provisions: work for which full plans are not required), for "1st October 2009" substitute "6th April 2010 and for "6th April 2010" substitute "1st October 2010;
(d) in regulation 7 (transitional provisions: full plans), for "1st October 2009" substitute "6th April 2010" and for "1st October 2010" substitute "6th April 2011"; and
(e) in regulation 8 (transitional provisions: plans certificates), for "1st October 2009" in both places where it occurs substitute "6th April 2010", and for "1st October 2010" substitute "6th April 2011.
3. In the Building (Amendment No.2) Regulations 2009(3), in regulation 1(2) (citation and commencement), for "1st October 2009" substitute "6th April 2010".

These Regulations amend the Building and Approved Inspectors (Amendment) Regulations 2009 and the Building (Amendment No.2) Regulations 2009.
Regulation 2 amends the Building and Approved Inspectors (Amendment) Regulations 2009 to postpone their coming into force, by substituting 6th April 2010 for the coming into force date of 1st October 2009 in regulation 1(2), and by making corresponding changes in the transitional provisions in regulations 5 to 8.
Regulation 3 amends the Building (Amendment No.2) Regulations 2009 to postpone their coming into force, by substituting 6th April 2010 for the coming into force date of 1st October 2009 in regulation 1(2).
A full impact assessment has not been produced for these Regulations as no effect on the private or voluntary sectors is foreseen.
1984 c.55. Section 1 was amended by the Sustainable and Secure Buildings Act 2004 (c.22), section 1(1) to (3); section 35A(2) was inserted by the Climate Change and Sustainable Energy Act 2006 (c.19), section 13(1), and repealed by section 317(4) of the Housing and Regeneration Act 2008 (c.17), subject to a saving in section 317(5) of that Act; section 47 was amended by section 8(2) of the Sustainable and Secure Buildings Act 2004 and article 3(2) of S.I. 1996/1905; paragraph 4A of Schedule 1 was inserted by section 8(1) of that Act; paragraph 7 of Schedule 1 was amended by section 3(1), (4) and (5) of that Act- there are other amendments to that paragraph but none is relevant; paragraph 8 of Schedule 1 was amended by section 3(1), (6) and (7) of that Act.
