The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 7A and 60(4) of the National Lottery etc. Act 1993(1).
1. These Regulations may be cited as the National Lottery (Annual Licence Fees) Regulations 2010 and shall come into force on 28th January 2010.
2. In these Regulations –
"the 1993 Act" means the National Lottery etc. Act 1993,
"the Commission" means the National Lottery Commission.
3. The holder of a licence under section 5 of the 1993 Act shall pay –
(a) a first annual fee of £35,000 to the Commission within 12 months after the issue of the licence,
(b) an annual fee of £3,900 to the Commission before the first anniversary and before each subsequent anniversary of the issue of the licence.
4. Subject to regulations 5 and 6, the holder of a licence under section 6 of the 1993 Act to promote lotteries shall pay –
(a) a first annual fee of £2,500 to the Commission within 12 months after the issue of the licence, and
(b) an annual fee of £2,500 to the Commission before the first anniversary and before each subsequent anniversary of the issue of the licence.
5. Subject to regulation 6, the holder of a licence under section 6 of the 1993 Act authorising the promotion of an unrestricted number of lotteries which fall within a particular description specified in the licence, shall pay –
(a) a first annual fee of £8,000 to the Commission within 12 months after the issue of the licence, and
(b) an annual fee of £8,000 to the Commission before the first anniversary and before each subsequent anniversary of the issue of the licence.
6. The holder of a licence under section 6 of the 1993 Act authorising the promotion of a lottery pursuant to an agreement, entered into between the licencee and the promoters of other lotteries in other countries of the European Union, under which lotteries falling within the agreement share a common game structure and prizes, shall pay –
(a) a first annual fee of £16,000 to the Commission within 12 months after the issue of the licence, and
(b) an annual fee of £16,000 to the Commission before the first anniversary and before each subsequent anniversary of the issue of the licence.

These Regulations prescribe the sums payable as annual fees by the holder of a licence under sections 5 or 6 of the National Lottery etc. Act 1993 (c.39) ("the 1993 Act") to the National Lottery Commission.
The first annual fee is payable within 12 calendar months of the issue of the licence. Thereafter a first anniversary fee is payable before the first anniversary of the issue of the licence, and further anniversary fees are payable before each subsequent anniversary of the issue of the licence.
