The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 242A and 272(7) of the National Health Service Act 2006(1).
1.-"(1) These Regulations may be cited as the National Health Service (Strategic Health Authorities: Further Duty to Involve Users) Regulations 2010.
(2) These Regulations come into force on 1st April 2010.
2. Each Strategic Health Authority must make arrangements which secure that health service users are, directly or through representatives, involved (whether by being consulted, or provided with information, or in other ways) in the matters specified in regulation 3.
3.-"(1) The matters referred to in regulation 2 are the preparation and review of plans made by or on behalf of a Strategic Health Authority which set out strategies for-"
(a) improving the health of people in the area of the Authority; or
(b) the provision of health services in the area of the Authority which, if implemented, would have an impact on-"
(i) the manner in which services are delivered to health service users, or
(ii) the range of services available to those users.
(2) The plans referred to in this regulation include plans made by or on behalf of the Strategic Health Authority jointly with another person.

These Regulations place a duty on each Strategic Health Authority to make arrangements to further involve users pursuant to section 242A of the National Health Service Act 2006 (c.41). This duty is in addition to the duty to involve users under section 242(1B) of that Act.
Regulations 2 and 3 require each Strategic Health Authority to involve users in the preparation and review of plans made by or on behalf of the Authority, including plans made jointly with another person, which set out strategies for improving the health of the people in its area or for the provision of services within its area. The duty applies to plans about the provision of services only where those plans would have an impact on the range of services or the manner in which they are delivered.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
