The Equality Act 2010 (Commencement No. 2) Order 2010

The Secretary of State, in exercise of the powers conferred by section 216(3) of the Equality Act 2010(1), makes the following Order:

Citation and interpretation

1.-(1) This Order may be cited as the Equality Act 2010 (Commencement No. 2) Order 2010.

(2) In this Order-

"Commencement Order No. 1" means the Equality Act 2010 (Commencement No. 1) Order 2010(2); and

"subordinate legislation" means Orders in Council, orders, rules or regulations.

Provisions conferring power to make subordinate legislation etc

2.-(1) The provisions of the Equality Act 2010 specified in paragraph (2) come into force on the day after the day on which this Order is made, so far as they relate to the provisions listed in Table 2 of the Schedule to Commencement Order No. 1 and in so far as necessary for the purpose of making subordinate legislation or guidance under the provisions so listed.

(2) The provisions are-

(i)section 6(6)

(ii)section 38(8),

(iii)section 80(8),

(iv)section 83(11) ,

(v)section 94(12) ,

(vi)section 116(3), and

(vii)section 189.

Provisions amending the Equality Act 2006

3. The following provisions of the Equality Act 2010 come into force on the day after the day on which this Order is made-

(a)subsection 211(1) so far as it relates to paragraph 6 of Schedule 26, and

(b)paragraph 6 of Schedule 26 so far as it relates to paragraph 10(1), (2) and (3) and (5) of that Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)

This is the second Commencement Order made under the Equality Act 2010. Article 2 commences further provisions of that Act to supplement provisions previously commenced by the Equality Act (Commencement No. 1) Order 2010 S.I. No. 2010/1736 (C.91) so far as necessary for making subordinate legislation and guidance and Article 3 commences a further provision in relation to making Codes of Practice under the previously commenced provisions.
