The Secretary of State, in exercise of the powers conferred by paragraph 1 of Schedule 2 to the Police Act 1996 (1), makes the following Regulations.
In accordance with paragraph 6 of Schedule 2 to that Act the Secretary of State has consulted with the Association of Police Authorities, persons whom she considers to represent the interests of county and district councils in England and county and county borough councils in Wales, and such other persons as she thought fit.
1. These Regulations may be cited as the Police Authority (Amendment) Regulations 2010 and shall come into force on 1st November 2010.
2. In regulation 41(5) of the Police Authority Regulations 2008(2) (requirement to advertise) for -�two-� substitute -�four-�.

These Regulations amend the Police Authority Regulations 2008 (S.I. 2008/630) to widen the circumstances in which a police authority need not advertise for new independent members. Under the 2008 Regulations there is no requirement to advertise if a selection panel decides to nominate candidates who have previously applied, there are at least twice as many candidates as appointments to be made, and the vacancy occurs less than two years after an advertisement was last published. These Regulations increase that maximum period from two to four years.
