The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 1(1) of the Consular Fees Act 1980(1), is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows:

1. This Order may be cited as the Consular Fees (Amendment) Order 2011 and comes into force on 27th July 2011.

2.-(1) Part 2 of Schedule 1 to the Consular Fees Order 2011(2) is amended as follows.

(2) In paragraph A(a) and (b) and in paragraph B, after "in addition to direct costs if any" insert ",other than delivery costs to the extent that these fall within paragraphs BA to BC, and in addition to any fee relevant to the application set out in paragraphs BA to BC".

(3) After paragraph B insert-�

"BAArranging delivery of a passport for an application made abroad for a 32 or 48 page passport and if the application is successful, delivering the passport-
(a)to a British Forces Post Office address where the applicant is a member of or attached to Her Majesty's Diplomatic Service or a dependant of such a person5.77
(b)to a United Kingdom address (other than a British Forces Post Office address) where the applicant is a member of or attached to Her Majesty's Diplomatic Service or a dependant of such a person5.47
(c)to a British Forces Post Office address, where the applicant is a member of the Armed Forces or a dependant of such a person5.47
(d)to a United Kingdom embassy, High Commission or consulate by diplomatic channels11.41
(e)to an address specified by the applicant or the Secretary of State, where (a) to (d) do not apply9.70
BBArranging the return of supporting documents accompanying an application or applications (up to a maximum of four applications) made abroad for a 32 or 48 page passport10.16
BCForwarding an application or applications (up to a maximum of four) made abroad for a 32 or 48 page passport to a Regional Passport Processing Centre for consideration13.31"

3. The amendments made by this Order to the Consular Fees Order 2011 do not apply in relation to an application where any passport provided will be printed other than in the United Kingdom.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Consular Fees Order 2011 ("the 2011 Order"). Whereas previously delivery costs were included within "direct costs" as defined in article 2 of the 2011 Order, this Order amends the 2011 Order so as to make specific provision in respect of delivery costs. The effect of these changes will be to increase the delivery fees in respect of some applications and reduce them in respect of others. The average increase per applicant is £9.82.

Article 2(3) inserts new paragraphs BA to BC in Part 2 of Schedule 1 to the 2011 Order. Paragraph BA provides that the fee for arranging delivery of a passport (whether 32 or 48 page) will generally be £9.70 (sub-paragraph (e)). However there are four particular circumstances where a different fee is prescribed; where the applicant is a member of the Armed Forces (or a dependant of such a member) and the passport is sent to a British Forces Post Office address the fee is £5.47 (sub-paragraph (c)); where the applicant is a diplomat or an official in the Diplomatic Service (or a dependant of such a person) and the passport is sent to a British Forces Post Office address the fee is £5.77 (sub-paragraph (a)); where the applicant is such a person and the passport is sent to a United Kingdom address (other than a British Forces Post Office address) the fee is £5.47 (sub-paragraph (b)); where the delivery is by diplomatic channels the fee is £11.41 (sub-paragraph (d)).

Paragraph BB prescribes a fee of £10.16 for the return of supporting documents accompanying an application; a single fee is payable for documents relating to up to four applications.

Paragraph BC prescribes a fee of £13.31 for forwarding an application to a Regional Passport Processing Centre for consideration; up to four applications will attract a single fee.

Article 2(2) amends references to "direct costs" in paragraphs A and B of Part 2 of Schedule 1 to the 2011 Order to make it clear that this does not include delivery costs, where such costs are provided for in new paragraphs BA to BC.

Article 3 contains a supplemental saving provision. This provides that the amendments made by the Order will not apply where the relevant passport would be printed abroad.
