The Secretary of State makes the following Order in exercise of the powers conferred by section 1(7) of the Derelict Land Act 1982(1).
In accordance with section 1(8) of that Act, (a) the Secretary of State is of the opinion that the economic situation in the locality to which this Order applies is such that the making of the Order would be particularly appropriate with a view to contributing to the development of industry in the locality; and (b) the Treasury have consented to the making of this Order.
1. This Order may be cited as the Derelict Land Clearance Area (Highbarns, Hemel Hempstead) Order 2011 and comes into force on 10th October 2011.
2.-(1) Subsections (1) to (6) of section 1 of the Derelict Land Act 1982 shall have effect in relation to land in the locality shown bounded by the outside edge of a bold red line on the map, as they have effect in relation to land in a development area or intermediate area.
(2) In paragraph (1), "the map" means the map marked "Map referred to in the Derelict Land Clearance Area (Highbarns, Hemel Hempstead) Order 2011" and signed by authority of the Secretary of State, duplicates of which have been deposited, and are available for inspection, at the offices of the Dacorum Borough Council and at the offices of the Secretary of State.

This Order specifies an area as a derelict land clearance area.
Under section 1(7) of the Derelict Land Act 1982, the Secretary of State may, with the consent of the Treasury, specify by order that an area is a derelict land clearance area. The purpose of doing so is that the area may be treated under that section as if it were in a development or intermediate area. This means that the local authority in whose area the specified land is situated may apply for grant from the Secretary of State at the higher rates. This grant may be paid towards expenditure incurred in reclaiming land, improving or bringing it back into use.
The Order specifies an area in Highbarns, Hemel Hempstead, Hertfordshire as a derelict land clearance area. Former chalk mining activity has caused subsidence and the collapse of surface land in that locality. The area specified is shown on the map referred to in the Order. A copy of the map is available for inspection at Dacorum Borough Council, Hemel Hempstead Civic Centre, Marlowes, Hemel Hempstead, Hertfordshire, HP1 1HH and at the Department for Communities and Local Government, Eland House, Bressenden Place, London SW1E 5DU.
A full impact assessment has not been produced for this Order as no impact on the private or voluntary sectors is foreseen.
