The Safety of Sports Grounds (Designation) (No.2) Order 2012

The Secretary of State makes the following Order in exercise of the powers conferred by section 1(1) of the Safety of Sports Grounds Act 1975(1). In accordance with section 18(4) of that Act he has consulted with such persons and bodies as appear to him to be requisite.

Citation and Commencement

1. This Order may be cited as the Safety of Sports Grounds (Designation) (No.2) Order 2012 and comes into force on 20th July 2012.

Designation

2. The sports grounds specified in the Schedule to this Order, each of which being a sports ground-

(a)at which association football matches are played;

(b)which is occupied by a club which is a member of the Football League Limited; and

(c)which, in the opinion of the Secretary of State, has accommodation for more than 5,000 spectators(2),

are designated as sports grounds requiring a safety certificate under the Safety of Sports Grounds Act 1975.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates Highbury Stadium, occupied by Fleetwood Wanderers Limited (trading as Fleetwood Town Football Club), and New York Stadium, occupied by Rotherham United Football Club (RUFC) Limited, as sports grounds requiring a safety certificate under the Safety of Sports Grounds Act 1975.

A full impact assessment has not been produced for this instrument.

1975 c.52; section 1 was amended by sections 19 and 20 of, and Schedule 2 to, the Fire Safety and Safety of Places of Sport Act 1987 (c.27).

The Safety of Sports Grounds (Accommodation of Spectators) Order 1996 (S.I. 1996/499) substituted the number 5,000 for the number specified in section 1(1) of the Safety of Sports Grounds Act 1975 in respect of a sports ground at which association football matches are played and which is occupied by a club which is a member of either the Football League Limited or the Football Association Premier League Limited.
