The Jurors' Allowances (Amendment) Regulations 2012

The Lord Chancellor, with the consent of the Minister for the Civil Service, makes the following Regulations in exercise of the power conferred by section 19(1) of the Juries Act 1974(1):

Citation and commencement

1. These Regulations may be cited as the Jurors' Allowances (Amendment) Regulations 2012 and come into force on 30th July 2012.

Amendments to the Jurors' Allowances Regulations 1978

2. The Jurors' Allowances Regulations 1978(2) are amended as follows.

3. After regulation 7 (subsistence allowance to which a juror is entitled) insert-

"7A. A payment by way of allowance under section 19 of the Act will not be made to a juror summoned on or after 30th July 2012 to serve on a jury, unless that juror claims that payment within the period of 12 months beginning on the day following the final day on which he or she attends for service as a juror."

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which come into force on 30th July 2012, amend the Jurors' Allowances Regulations 1978 (SI 1978/1579) to prescribe a condition for payment of such allowances. The amendments provide that a juror will not receive payments pursuant to section 19 of the Juries Act 1974 (c. 23) unless a claim is made within 12 months of the conclusion of jury service. This change does not apply to any person summoned to serve as a juror on or before the coming into force of these Regulations i.e. 30th July 2012.

1974 c. 23; section 19(1) has been amended by paragraph 4 of Schedule 2 to the Administration of Justice Act 1977 (c. 38) and section 1(2) of, and Part 1 of Schedule 1 to, the Social Security (Consequential Provisions) Act 1975 (c. 18).
