The Secretary of State makes the following Order in exercise of the powers conferred by section 115(3) and (4) of the Protection of Freedoms Act 2012(1).
1.-(1) This Order may be cited as the Protection of Freedoms Act 2012 (Consequential Amendments) Order 2012 and comes into force on 1st October 2012.
(2) This Order applies as respects England only.
2. The Functions of Traffic Wardens Order 1970(2) is amended as follows.
3. In article 3(4)(b) for "land in the open air" substitute "other land".
4. In paragraph 4 of the Schedule for "land in the open air" substitute "other land".
5. The Removal and Disposal of Vehicles (Traffic Officers) (England) Regulations 2008(3) are amended as follows.
6. In regulation 8 for "land in the open air" substitute "other land".

This Order amends the Functions of Traffic Wardens Order 1970 and the Removal and Disposal of Vehicles (Traffic Officers) (England) Regulations 2008 to make a consequential amendment to the definition of land from which traffic wardens and traffic officers may remove vehicles. These amendments are consequential upon amendments made by section 55 of the Protection of Freedoms Act 2012 to the Road Traffic Regulation Act 1984 to the definition of land from which vehicles may be removed.
