The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) (Amendment) Regulations 2014

These Regulations are made in exercise of the powers conferred by section 91 of the Education Act 2002(1).

In accordance with section 96(2), (3) and (4) of that Act, the Secretary of State for Education gave notice of the proposal to the bodies and persons mentioned in those subsections and gave them a reasonable opportunity of submitting evidence and representations as to the issues arising.

In accordance with section 96(5), the Secretary of State published a draft of the proposed regulations and the associated documents, and a summary of the views expressed.

In accordance with section 96(6), the Secretary of State allowed a period of not less than one month beginning with the publication of the draft of the proposed regulations for the submission of further evidence and representations as to the issues arising.

The Secretary of State now makes the following Regulations.

Citation and Commencement

1.  These Regulations may be cited as the National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England)(Amendment) Regulations 2014 and come into force on 1st September 2014.

Amendments to the National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013

2.  The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013(2) are amended as follows.

3.  After Regulation 2(3) insert-

"(4) The programmes of study specified in relation to English and mathematics for the fourth key stage do not apply in relation to any pupil in the final year of the fourth key stage during the school year 2015 to 2016."

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013 which make provision for: (a) the National Curriculum to be disapplied, with exceptions, for all key stages for the school year 2013 to 2014 and (b) the programmes of study for the core subjects to be disapplied for the fourth key stage for the school year 2014 to 2015.

These Regulations provide for the programmes of study for the core subjects of English and mathematics to be disapplied for year 11 pupils for the school year 2015 to 2016.

An impact assessment has not been produced for this instrument as it has no impact on business or civil society organisations. The instrument has a minimal impact on the public sector.
