The St George's Healthcare National Health Service Trust (Transfer of Trust Property) Order 2014

The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 217(2), 272(7) and (8) of, and paragraph 10(3) of Schedule 4 to, the National Health Service Act 2006(1).

Citation, commencement and interpretation

1.  (1)  This Order may be cited as the St George's Healthcare National Health Service Trust (Transfer of Trust Property) Order 2014 and comes into force on 3rd March 2014.

(2) In this Order-

"the new trustee" means the trustee for St George's Healthcare National Health Service Trust, namely the St George's Healthcare National Health Service Trust Charity(2);

"the old trustee" means the St George's Healthcare National Health Service Trust(3); and

"the trust property" means the property specified in the schedule of trust property prepared by, and signed on behalf of, the old trustee, and the new trustee, on 15th January 2014.

Transfer of trust property

2.  (1)  The trust property, and any rights and liabilities arising from that property, are transferred from the old trustee to the new trustee.

(2) In any instrument relating to the trust property, any reference to the trustees of the trust property will be construed as a reference to the new trustee and any reference to the old trustee as the trustee for the trust property will be construed as a reference to the new trustee.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order transfers, under paragraph 10(3) of Schedule 4 to the National Health Service Act 2006, trust property held by St George's Healthcare National Health Service Trust to the trustee appointed for that Trust under the National Health Service Trusts (Trust Funds: Appointment of Trustee) Order 2000 (as amended) and makes related provision. A copy of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds LS2 7UE.

Known as St George's Hospital Charity. See S.I. 2000/3116 which amended S.I. 2000/212 to provide for the appointment of trustees for the St George's Healthcare National Health Service Trust.
