The Lord Chancellor, with the consent and sanction of the Treasury, makes the following Order in exercise of the powers conferred by section 92 of the Courts Act 2003(1).

In accordance with section 92(5) and (6) of the Courts Act 2003 the Lord Chancellor has consulted the Lord Chief Justice, the Master of the Rolls, the President of the Queen's Bench Division, the President of the Family Division, the Chancellor of the High Court, the Head of Civil Justice, the Deputy Head of Civil Justice and the Civil Justice Council.

Citation and commencement

1.  This Order may be cited as the Civil Proceedings Fees (Amendment No.3) Order 2014 and comes into force on 4th August 2014.

Amendments of the Civil Proceedings Fees Order 2008

2.  At fee 8.1 in Schedule 1 (fees to be taken) of the Civil Proceedings Fees Order 2008(2) for sub-paragraphs (a) and (b) substitute:

"(a) in CCBC cases or cases in which a warrant of control is requested in accordance with paragraph 11.2 of Practice Direction 7E to the Civil Procedure Rules (Money Claim OnLine cases);£70
(b) in any other case.£100"

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Civil Proceedings Fees Order 2008 (S.I 2008/1053).

The purpose of this Order is to correct a mistake in article 3(b) of the Civil Proceedings Fees (Amendment No.2) Order (S.I. 2014/1834), which amended fee 8.1 in Schedule 1 to the Civil Proceedings Fees Order 2008. Article 2 of this Order rectifies the position.

The effect is that the fee for a request for a warrant of control in the County Court which is made in accordance with paragraph 11.2 of Practice Direction 7E to the Civil Procedure Rules (Money Claim OnLine) is £70.
