The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 22(1) and (2) and 57 of the Vehicle Excise and Registration Act 1994(1).
1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) (No. 2) Regulations 2014.
(2) These regulations, other than regulation 4, come into force on 31st October 2014.
(3) Regulation 4 comes into force on 9th December 2014.
2. The Road Vehicles (Registration and Licensing) Regulations 2002(2) are further amended as follows.
3. (1) Regulation 23 (change of keeper: obligations of registered keeper where vehicle registration document issued in Great Britain on or after 24th March 1997 and the new keeper a vehicle trader) is amended as follows.
(2) In the heading, omit "in Great Britain".
(3) In paragraph (2)-
(a)for "The registered keeper shall", substitute "The registered keeper, or, a vehicle trader by or to whom the vehicle is sold or disposed of, acting on the registered keeper's behalf, must";
(b)after "Secretary of State" omit "on that part of the registration document which relates to the transfer to the vehicle trader, or otherwise in writing,";
(c)at the end of sub-paragraph (b), add "and";
(d)in sub-paragraph (c) omit the word "signed" and the final "and"; and
(e)omit sub-paragraph (d).
(4) After paragraph (2), insert-
"(2A) The Secretary of State may, if he thinks fit, accept a notification and declaration under paragraph (2) made orally by telephone or by electronic means and in any other case it must be made on that part of the registration document which relates to the transfer to a vehicle trader, or otherwise in writing.".
4. (1) Regulation 24 (change of keeper: obligations of vehicle traders where registration document issued in Great Britain on or after 24 March 1997) is amended as follows.
(2) In the heading, omit "in Great Britain".
(3) In paragraph (2), after "the appropriate date" omit "and on that part of the registration document which relates to a change of keeper,".
(4) In paragraph (5)-
(a)in sub-paragraph (a), after "the Secretary of State," omit "on that part of the registration document which relates to the change of keeper or otherwise in writing,";
(b)at the end of sub-paragraph (a)(ii), add "and";
(c)in sub-paragraph (a)(iii) omit the word "signed" and the final "and";
(d)omit sub-paragraph (a)(iv); and
(e)in sub-paragraph (b), for "those parts of it not required to be sent to the Secretary of State under sub-paragraph (a)" substitute "that part of it which is marked as the part to be given to the new keeper".
(5) In paragraph (7), omit the words "accompanied by that part".
(6) After paragraph (7), insert-
"(7A) The Secretary of State may, if he thinks fit, accept a notification under paragraph (2) or an application under paragraphs (2A), (6) or (7) or the information and declaration under paragraph (5)(a) made or given orally by telephone or by electronic means and in any other case-
(a)a notification under paragraph (2) must be made on that part of the registration document which relates to a change of keeper;
(b)the information and declaration under paragraph (5)(a) must be given on the part of the registration document which relates to a change of keeper or otherwise in writing;
(c)an application under paragraph (7) must be accompanied by that part of the registration document which is marked as the part to be given to the new keeper.".

These Regulations further amend the Road Vehicles (Registration and Licensing) Regulations 2002 ("the 2002 Regulations") (S.I. 2002/2742) to make provision to allow for notifications and applications in relation to vehicle registration arising on transfers to and dealings by a vehicle trader to be made by electronic means or by telephone. They also provide for vehicle traders to be able to notify the Secretary of State of the change of keeper on behalf of the registered keeper when there is a transfer to a vehicle trader.
Regulation 3 amends regulation 23 of the 2002 Regulations and permits, as the Secretary of State thinks fit, notification of the transfer of a vehicle to a vehicle trader to be given by telephone or by electronic means, in which case there is no need to return documents to the Secretary of State. It also allows the notification and supporting declaration to be given on the registered keeper's behalf by a vehicle trader.
Regulation 4 amends regulation 24 of the 2002 Regulations and enables relevant notifications, applications and requirements as to the giving of information and declarations which arise on vehicle traders when they are the registered keeper, to be transacted electronically or by telephone.

1994 c. 22; relevant amendments to section 22(1) were made by the Finance Act 1995 (c.4), Schedule 4, paragraph 34, the Finance Act 1996 (c. 8), Schedule 2, paragraphs 4(2) and (3), and prospectively by the Road Safety Act 2006 (c. 49), sections 47(4), (5), (7) and (8).
