The M40 Motorway (Junction 10 Improvements) (Connecting Roads) Scheme 2014

The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980 (1) and now vested in him (2):

1.  This Scheme may be cited as the M40 Motorway (Junction 10 Improvements) (Connecting Roads) Scheme 2014 and shall come into force on 20th September 2014.

2.  In this Scheme:

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (a) "the special roads" means each connecting road;

(b)"the plan" means the plan numbered HA/16/NDD/003, marked "The M40 Motorway (Junction 10 Improvements) (Connecting Roads) Scheme 2014", signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA; and

(c)"connecting road" means a special road along a route described in Schedule 1 to this Scheme.

3.  The Secretary of State is authorised to provide the special roads for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.

4.  The centre line of each of the special roads is indicated by a heavy black line on the plan.

5.  Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

SCHEDULE 1Route of the Connecting Roads

The routes of the connecting roads are as follows:

(1) a route to connect the roundabout on the A43 Trunk Road on the east side of the M40 Motorway (known as Cherwell Roundabout) to the existing slip road leading to the southbound carriageway of the M40 from Cherwell Valley Motorway Service Area. The connecting road along this route is given the reference number 1 on the plan and is 85 metres in length;

(2) a route to connect the exit road from the Cherwell Valley Motorway Service Area to the new route described in (1) above. The connecting road along this route is given the reference number 2 on the plan and is 18 metres in length;

all at Junction 10 of the M40 Motorway near Ardley in the County of Oxfordshire.

EXPLANATORY NOTE

(This note is not part of the Scheme)

The scheme authorises the Secretary of State to construct a new slip road connecting an improved roundabout on the A43 Trunk Road near Cherwell Valley Motorway Service Area (known as Cherwell Roundabout) with the existing slip road leading from the service area to the southbound carriageway of the M40 at Junction 10. The slip road leading from the A43 Padbury Roundabout to the southbound carriageway of the M40 would then be closed. A new link road would also be provided from the service area exit road to the new southbound entry slip road. It is part of an improvement scheme designed to reduce congestion at this motorway junction.
