The Secretary of State makes the following Order in exercise of the power conferred by section 59(1) of the Crime and Security Act 2010(1).

Citation

1.  This Order may be cited as the Crime and Security Act 2010 (Commencement No. 7) Order 2014.

Commencement

2.  The following provisions of the Crime and Security Act 2010 shall come into force on 8th March 2014-

(a)sections 24 to 30 (domestic violence) insofar as they are not already in force; and

(b)section 31 (guidance).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force sections 24 to 31 of the Crime and Security Act 2010 on 8th March 2014 across police forces throughout England and Wales. Previously, sections 24 to 30 had been commenced, but only in relation to three specified police areas. These provisions include the power for an authorising officer to issue a domestic violence protection notice to an alleged perpetrator of domestic violence, and the power for a magistrates' court, on an application made by complaint by a constable, to make a domestic violence protection order.

Section 31 provides a power for the Secretary of State to issue guidance relating to the exercise by a constable of functions under these provisions, and imposes a statutory duty on constables to have regard to any such guidance when exercising functions to which the guidance relates.
