The Lord Chancellor, with the concurrence of the Senior President of Tribunals, makes the following Order in exercise of the power conferred by section 7(9) of the Tribunals, Courts and Enforcement Act 2007(1).

Citation and commencement

1.  This Order may be cited as the First-tier Tribunal and Upper Tribunal (Chambers) (Amendment) Order 2015 and comes into force on 1st October 2015.

Amendments to the First-tier Tribunal and Upper Tribunal (Chambers) Order 2010

2.-(1) The First-tier Tribunal and Upper Tribunal (Chambers) Order 2010(2) is amended as follows.

(2) In article 5A (functions of the Property Chamber)(3), after sub-paragraph (h) substitute a semi-colon for the full stop and insert-

"(i)proceedings for approval by the First-tier Tribunal of the exercise of a power of entry, made under paragraph 6B of Schedule 9 to the Local Government Finance Act 1988(4) or under section 25A of the Local Government Finance Act 1992(5).".

(3) In article 6 (functions of the Social Entitlement Chamber), after sub-paragraph (e) insert-

"(ea)appealable decisions within the meaning of section 56(3) of the Childcare Payments Act 2014(6);".

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the First-tier Tribunal and Upper Tribunal (Chambers) Order 2010 (S.I. 2010/2655) to reflect the conferral of further functions on the First-tier Tribunal.

Functions are conferred on the Property Chamber of the First-tier Tribunal to approve the exercise of statutory powers of entry conferred on listing officers and valuation officers of the Valuation Office Agency where the occupier of the property has refused consent.

Functions are conferred on the Social Entitlement Chamber of the First-tier Tribunal in relation to appeals regarding childcare payments.

An impact assessment has not been prepared for this instrument as it does not affect business, charities, voluntary bodies or the public sector.
