The Secretary of State, who is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the regulation of medical devices(2), makes the following Regulations in exercise of the powers conferred by section 2(2).

Citation and commencement

1.  These Regulations may be cited as the Clinical Thermometers (EEC Requirements) (Revocation) Regulations 2015 and come into force on 1st April 2015.

Revocation

2.  The Clinical Thermometers (EEC Requirements) Regulations 1993(3) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulation)

These Regulations revoke the Clinical Thermometers (EEC Requirements) Regulations 1993. The 1993 Regulations implemented Council Directive No.76/64/EEC(4), as amended, relating to mercury in glass thermometers. This Directive is no longer in force. Modern clinical thermometers do not use mercury and are covered by the provisions under the Medical Devices Directive 93/42/EC(5), which is given effect by the Medical Devices Regulations 2002(6).

No impact assessment has been prepared in relation to this instrument as no impact on business is foreseen.
