EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the City of London Corporation (in the various capacities in which it exercises power to make byelaws in relation to open spaces outside of the City of London) for the purposes of section 71 of the Anti-social Behaviour, Crime and Policing Act 2014 (c. 12) ("the 2014 Act") in relation to specified land. As a result of the designation, the City of London Corporation (in its various capacities) has the powers of a local authority under Chapter 2 of Part 4 of the 2014 Act in relation to the specified land. This includes the power to make public spaces protection orders and to authorise persons to issue fixed penalty notices.

This Order also amends the London Government Reorganisation (Hampstead Heath) Order 1989 (S.I. 1989/304) in order to ensure that the powers conferred under this Order may be exercised in relation to Hampstead Heath (including Golders Hill Park).

An impact assessment was prepared for the 2014 Act and is available at www.gov.uk/government/publications/anti-social-behaviour-crime-and-policing-bill-anti-social-behaviour.
