The Secretary of State makes the following Regulations in exercise of the power conferred by section 84(3) of the Energy Act 2016(1).
1. These Regulations may be cited as the Energy Act 2016 (Commencement No. 3) Regulations 2016.
2. The following provisions of the Energy Act 2016 come into force on 19th December 2016-
(a)section 34 (power of the OGA to require information and samples), except sub-section (1)(b), and
(b)section 36 (appeals against decisions of the OGA: information and samples plans) insofar as it applies to a decision of the OGA to give a notice under section 34(1)(a).

These Regulations bring into force specified provisions of the Energy Act 2016 (c. 20) ("the Act"). They are the third commencement regulations made under the Act.
All of the provisions of the Act except sections 30 to 36 have already come into force.
Regulation 2 commences all of section 34 of the Act except section 34(1)(b), and section 36 of the Act insofar as it applies to a decision of the Oil and Gas Authority ("the OGA") to give a notice under section 34(1)(a). The commenced provisions give the OGA the power to require a relevant person to provide it with petroleum-related information and samples, and provide a right of appeal to the First-tier Tribunal on prescribed grounds against the exercise of this power by the OGA.
An impact assessment of the effect that the Act will have on the costs of business and the voluntary sector has been produced, and a copy is available at www.legislation.gov.uk. No separate impact assessment has been produced for this instrument.
