The United Nations and European Union Financial Sanctions (Linking) Regulations 2017

The Treasury, in exercise of the powers conferred by section 154 of the Policing and Crime Act 2017(1), make the following Regulations.

Citation and commencement

1.  These Regulations may be cited as the United Nations and European Union Financial Sanctions (Linking) Regulations 2017 and come into force on 1st April 2017.

Linking provisions

2.-(1) For the purposes of section 155 of the Policing and Crime Act 2017, each UN financial sanctions Resolution listed in the first column of the table in the Schedule to these Regulations is linked to the EU financial sanctions Regulation listed in the corresponding entry in the second column of the table.

(2) In these Regulations, any reference to a UN financial sanctions Resolution or to an EU financial sanctions Regulation is to have effect as a reference to the UN financial sanctions Resolution or (as the case may be) to the EU financial sanctions Regulation as varied or supplemented from time to time.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations link UN financial sanctions Resolutions ("UNFSRs") with the corresponding EU financial sanctions Regulations ("EUFSRs"), arranged alphabetically by regime, for the purposes of section 155 of the Policing and Crime Act 2017 (c. 3) ("the Act").

Regulation 2(1) provides that each UNFSR listed in the first column of the table in the Schedule to these Regulations is linked to the EUFSR listed in the corresponding entry in the second column of the table. The references to UNFRSs and EUFRSs in the table are references to those Resolutions and Regulations as varied or supplemented from time to time (see regulation 2(2)).

The linking of the UNFRSs and EUFRSs in this way means that, where a person is designated for the purposes of a UNFSR, and the person is not already included in the list of persons designated under the EUFSR, that person is to be to be treated for a temporary period (a maximum of 30 days) as if included in the corresponding EUFSR list. This has the effect of applying the financial sanctions regime established by the EUFSR to that person for the temporary period.

An impact assessment has not been prepared for this instrument because no impact on the private or voluntary sector is foreseen.
