Statutory Instruments
Local Government, England
Made
30th November 2018
Coming into force in accordance with article 1
Under section 58(4) of the Local Democracy, Economic Development and Construction Act 2009 (1) ("the Act"), the Local Government Boundary Commission for England(2)("the Commission") published a report dated March 2017 stating its recommendations for changes to the electoral arrangements for the city of Leeds, which it gave effect to by making the Leeds (Electoral Changes) Order 2017(3) under section 59(1) of the Act.
The Commission is satisfied that a mistake has occurred in the preparation of that Order and that the mistake is such that it can be rectified by a subsequent order under section 59(1) of the Act by virtue of section 14 of the Interpretation Act 1978(4).
The Commission makes the following Order in exercise of the power conferred by section 59(1) of the Act. A draft of this instrument has been laid before each House of Parliament, a period of forty days has expired since the day on which it was laid and neither House has resolved that the instrument be not made.
1. This Order may be cited as the Leeds (Electoral Changes) (Amendment) Order 2018 and comes into force on the day after the day on which it is made.
2. In the Leeds (Electoral Changes) Order 2017, in article 2, for paragraph (1), substitute-
"(1) In this Order, "the map" means the map held by the Local Government Boundary Commission for England(5), which is marked "Revised Map (2018) referred to in the Leeds (Electoral Changes) Order 2017."
(This note is not part of the Order)
This Order amends the Leeds (Electoral Changes) Order 2017 ("the 2017 Order") which gave effect to recommendations for changes to electoral arrangements for the city of Leeds, stated in the Local Government Boundary Commission Report of March 2017. Article 2(1) of the 2017 Order referred to a map ("the Map referred to in the Leeds (Electoral Changes) Order 2017"), which showed an incorrect boundary between the wards of Beeston & Holbeck and Farnley & Wortley.
Article 2 of this Order amends article 2(1) of the 2017 Order so that it refers to the map as revised to reflect the Local Government Boundary Commission for England's recommendations.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
The Local Government Boundary Commission for England was established on 1st April 2010 by section 55(1) of the Local Democracy, Economic Development and Construction Act 2009.
Printed copies of the map are available for inspection at reasonable times at the principal office of the Local Government Boundary Commission for England, 1st Floor, 50 Victoria Street., London, SW1H 0TL.
