The Recovery of Costs (Remand to Youth Detention Accommodation) (Amendment) Regulations 2018

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 103(2)(a) and (6) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012(1).

Citation and commencement

1.  These Regulations may be cited as the Recovery of Costs (Remand to Youth Detention Accommodation) (Amendment) Regulations 2018 and come into force on 1st April 2018.

Amendment to the Recovery of Costs (Remand to Youth Detention Accommodation) Regulations 2013

2.  Regulation 3 of the Recovery of Costs (Remand to Youth Detention Accommodation) Regulations 2013(2) is amended as follows-

(a)in paragraph (4)(d), after "2017" insert "(but before 1st April 2018)";

(b)after paragraph (4)(d) insert-

"(e)on or after 1st April 2018, £189.";

(c)in paragraph (5)(i), after "2017" insert "(but before 1st April 2018)";

(d)after paragraph (5)(i) insert-

"(i)on or after 1st April 2018, £546.".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Recovery of Costs (Remand to Youth Detention Accommodation) Regulations 2013 (S.I. 2013/507) by inserting new amounts that designated authorities are liable to pay the Secretary of State in respect of each night on which a child is detained on remand in a young offender institution (decreased from £191 to £189), or a secure training centre (increased from £536 to £546) on or after 1st April 2018.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
