The Secretary of State, in exercise of the power conferred by section 57(2) of the Agriculture Act 2020( 1), makes the following Regulations.
1. These Regulations may be cited as the Agriculture Act 2020 (Commencement No. 1) Regulations 2020.
2. The following provisions of the Agriculture Act 2020 come into force on 1st January 2021—
(a) section 20 (declaration relating to exceptional market conditions), and
(b) section 21 (exceptional market conditions: powers available to Secretary of State).

These Regulations bring into force two sections of the Agriculture Act 2020 (c. 21)(“the Act”).
These are the first commencement regulations under the Act.
Regulation 2(a) brings into force, on 1st January 2021, section 20 of the Act, which provides for the Secretary of State to make and publish a declaration that there are “exceptional market conditions” (as defined in that section) which justify the making available of powers conferred by section 21 of the Act.
Regulation 2(b) brings into force, on 1st January 2021, section 21 of the Act, which provides that the Secretary of State may, while a declaration made under section 20 of the Act has effect, give, or agree to give, financial assistance to agricultural producers in England, subject to such conditions as the Secretary of State considers appropriate.
